In view of above stated detailed discussion on the above points and the result thereof, since the prosecution has successfully proved its case against the accused namely Atta Hussain S/O Jhando Khan, Rajab Ali S/O Ghulam Hussain, Abdul Waheed @ Waheed Ali S/O Peer Bux and Jhando @ Hajan S/O Shahzado for murdering the deceased Mureed Hussain and causing injury to the injured/P.W Abdul Fattah by way firing upon them, therefore, they deserve punishment. However, question of quantum of punishment arises whether accused may be awarded capital punishment or life imprisonment for life. It has time and again been reiterated by the Honourable Apex Court that while death sentence is a usual penalty in case of Qatl-e-Amd, life imprisonment being legal punishment may be considered. In such circumstance having regard facts and circumstances of the case I am of the opinion that element of mitigating exits, therefore, instead of awarding death sentence it is more appropriate to award imprisonment for life. Hence I while exercising powers so conferred upon me for committing murder of deceased Mureed Hussain and accused Atta Hussain S/O Jhando Khan, Rajab Ali S/O Ghulam Hussain, Abdul Waheed @ Waheed Ali S/O Peer Bux and Jhando @ Hajan S/O Shahzado are convicted under section 265-H (ii) Cr.P.C for an offence U/S 302 P.P.C punishable U/S 302(b) P.P.C. for life imprisonment. They shall jointly and severally, pay compensation to the tune of Rs.20,00,000/- only to the legal heirs/walis of deceased Mureed Hussain as provided U/S 544-A Cr.P.C., failing which they shall suffer simple imprisonment of three years. They are further convicted for another offence punishable under section 148 R/W section 149 PPC for the member of unlawful assembly in furtherance of their common object for attempting to commit Qatl-e-Amd of deceased Mureed Hussain and causing injuries on the person of injured Abdul Fattah and sentenced to undergo R.I for one year and to pay fine of Rs.20000/each only and if they fail to pay fine amount they shall further suffer 01 month S.I. They are further convicted for another offence punishable under section 337-A(iii) PPC for causing injuries on the person of injured Abdul Fattah and sentenced to undergo R.I for Five years and to pay compensation of Rs.2,00,000/- only to the injured Abdul Fattah jointly and severally, in case of failure to payment, they shall further suffer 06 months S.I. They are further convicted for another offence punishable under section 337-H(ii) PPC being member of unlawful assembly in furtherance of their common object of making aerial firing so rashly and negligently as to endanger the human life and personal safety of others and sentenced to undergo R.I for 01 year and to pay fine of Rs.10,000/each- only, in case of default in payment of fine, they shall further suffer 01 months more S.I. The sentences on account of nonpayment of compensation and fine shall run concurrently. They are given benefit under section 382-B Cr. P.C from the date of their arrest viz.25-04-2023 (accused Atta Hussain and Rajab), 07-05-2023 (accused Abdul Waheed) and 02-01-2025 (accused Jhando @ Hajan in respect of sentences so awarded under section 302-B , 148/149, 337-A(iii) and 337-H(ii) PPC. In view of above stated detailed discussion on the above point and the result thereof, since the prosecution has successfully proved its case against accused namely Atta Hussain for possessing an unlicensed rifle of .44 bore which was used by him in murdering of innocent deceased namely Mureed Hussain along with other accused and causing injuries to injured Abdul Fattah. Therefore, under such circumstances he deserves punishment. Accordingly, while I exercising powers so conferred upon me under section 265-H (ii) of criminal procedure code and convict the accused above named for an offence punishable under section 25 of Sindh Arms Act 2013 and he is sentenced to undergo R.I for 07 years and to pay fine of Rs. 50,000/- (rupees Fifty Thousand only). In case of failure in payment of fine, the convict accused shall undergo six months more simple imprisonment. He remained in jail since his arrest viz.03.05.2023, therefore, he is given benefit under section 382-B of Criminal Procedure Code.
