Accused Ali Dad @ Dadan s/o Mehar Ali Thebo, accused Himath Ali alias Alyo s/o Mehar Ali Thebo, and accused Imdad Ali s/o Mehar Ali Thebo are convicted for offence u/s 302 (b) read with section 34 PPC and sentenced to suffer life Imprisonment as Ta???zir. They are also directed to pay compensation of Rs.2,00,0000/each accused (Rupess Twenty lacs only each accused) as compensation under section 544-A Cr.P.C to the legal heirs of the victim. And in case of default of payment of compensation they shall suffer SI for (02) years more. b. Accused Ali Dad @ Dadan s/o Mehar Ali Thebo, Himath Ali alias Alyo s/o Mehar Ali Thebo, and Imdad Ali s/o Mehar Ali Thebo are convicted for offence u/s 201 with section 34 PPC and sentenced to suffer RI for 05 years and fine of Rs.50,000/each accused and in case of default of fine amount the accused shall suffer SI for 03 months more. c. Benefit of section 382-B Cr. P.C to the accused. Accused Ali Dad @ Dadan s/o Mehar Ali and Himath Ali alias Alyo s/o Mehar Ali Thebo are present on bail but accused Imdad wilfully absented at the time of judgment. Bail bonds of accused are cancelled and sureties of accused are discharged except surety of accused Imdad which is forfeited. Accused Ali Dad @ Dadan s/o Mehar Ali Thebo and Himath Ali alias Alyo s/o Mehar Ali Thebo are taken into custody and remanded to Jail Superintendent to serve out their sentence as per law. The conviction/arrest warrant of absent accused Imdad Ali s/o Mehar Ali Thebo is issued accordingly issued to the Superintendent of Police to arrest the accused and commit him to the Jail to serve out the sentences in according to the law and rules. Copy of the judgment is provided to the accused/convict free of costs. The convicts are informed about appeal period as per Limitation Act, 1908. The Jail Superintendent is directed to facilitate the accused/convicts to prefer the appeal as per rules and Jail Manual, if so advised.
