Accused are convicted under section:245 (2) Crpc and sentenced as mentioned in Judgment. I instead of sentencing accused persons to prison, keeping in view the concept of law, facts and circumstances of the case, I find the present case fit where the accused can be sent on probation, I therefore exercise the powers under section 5 of probation of Offenders Ordinance and under the supervision of the Probation Officer 12 months, upon executing the requisite bonds subject to furnishing surety of Rs.10,000/- and PR bonds of the equal amounts. As the accused persons are on bail and has furnished surety of the same amount before Honourable sessions Court; therefore, the same will be suffice for their probation bond. The bond shall contain a condition that during the period of probation, the accused shall restrain from any immoral, illegal activities and felonies and shall also improve his behavior. There will be no stigma of conviction on the probationer as per provision of Section 11 of the said Ordinance. However, in the case of violation of any terms and condition of the probation bond, the probation officer may submit a report before this court and on such report an appropriate order of imposing a fresh condition or extending the period of probation or even cancellation of the probation order will be passed and the original punishment will be executed. Copy of this Judgment shall be given to accused persons free of cost and copy shall also be forwarded to Probation officer for information and compliance.
