Suit called. Plaintiff along with his counsel is in attendance. Attorney of defendant namely Noor Ahmed is also present without his counsel. Order on order sheet. During hearing both parties have recorded their willingness for settlement of matter through arbitration. In the meantime, both parties were directed to submit name of Arbitrator who has accordingly been suggested through statement as Mr. Jam Abdul Fatah Samejo, Advocate. In view of consent of both parties, matter in hand is accordingly forwarded to Mr. Jam Abdul Fatah Samejo, Advocate, appointing him as Arbitrator to resolve the controversies/issues, amongst the parties followed by proper procedure/notice provided in section 89-A CPC. Matter called .Both private parties are called absent and their counsel ae present .Heard. Order passed on order sheet. By this single order, I am intending to dispose of applications U/O XVI Rule 1 & 2 R/w Section 151 CPC, filed by learned counsel for defendants No.3 & 4, respectively, praying therein to allow them to examine witnesses listed therewith. Notice thereof extended to the rival side but they haven???t preferred their objections. 02. Having heard learned counsel for both defendants, record in hand is perused; which emanates that, plaintiff Ghulam Mustafa has instituted the suit in hand with title ???Suit for Declaration, Cancellation, Possession, Mesne Profit & Permanent Injunction???, issues have been settled as per controversy between the parties, plaintiff side lead their evidence and closed their side on 07.11.2025; hence, present applications have been preferred by both defendants. Merely, delay observed in filing the applications in hand. Since, the delay doesn???t seems to be malafide on the part of defendants and their right of examination of witnesses cannot be withheld on such ground alone. Accordingly, both applications are allowed with no order as to costs. Defendants are directed lead their evidence by the next date of hearing. Put off to 27.04.2026.For D.E.
