Cr. B.A. No. 1928 of 2026, filed on behalf of the applicant/accused Ali Sher Gadani, fixed at Sr. No. 1 of today???s cause list generated through the CFMS-DC system, is taken up in open Court. In this regard, this Court verified the certificate appended to the instant bail application by counsel for the applicant/accused, which states that ???it is the first post-arrest bail application.??? In order to resolve the said ambiguity, and in view of the contention raised by counsel for the complainant, this Court verified the CFMS-DC system, the perusal whereof reveals that the first post-arrest bail application of the present applicant/accused along with co-accused Aijaz, bearing Cr. B.A. No. 1116 of 2026, dated 11.06.2026, had already been dismissed on merits by this Court. Thus, it transpires that the instant application is a second post-arrest bail application, whereas counsel for the applicant/accused, in the memo of the instant bail application, has mentioned it to be the first post-arrest bail application, thereby concealing the fact regarding the filing and dismissal of the earlier post-arrest bail application. Thereafter, counsel for the applicant/accused submitted that the Sessions Court, Ghotki, had not mentioned the fact that the instant post-arrest bail application had initially been filed before that Court and was subsequently transferred to this Court. Whatever the reason may be, counsel for the applicant/accused, endorsed a note of ???not pressed??? on the memo of instant post-arrest bail application. Accordingly, the instant post-arrest bail application filed on behalf of the applicant/accused stands dismissed as not pressed.

Cr.BA No. 1917 of 2026 of applicant/accused fixed at Sr. No.2 of today???s cause list generated from CFMS-DC system is taken up in open Court. The applicant/accused is present on interim pre-arrest bail granted to them vide order dated 24.08.2026 by the learned Sessions Judge Ghotki. The counsel for applicant/accused and DDPP for the State are present. It has been pointed out by counsel for applicant/accused that co-accused had already been acquitted by this Court on the ground that it was case of no evidence. Either it is the contention of the counsel for applicant/accused to be treated on merits or it is the contention on deeper appreciation at bail stage. The query was made from the counsel for applicant/accused why proper application for acquittal of accused has not been filed on behalf of applicant/accused and he submitted that he will file proper application in the course of the day. This Court, however considering the facts and in order to pass order has gone through the R&Ps bearing S.C No. 694/2009 in which applicant/accused has joined the trial. It appears that vide judgment dated 20.04.2016 one of accused Bahram had been acquitted by the then Presiding Officer of this Court on the ground the eye witness account had not implicated any accused in the commission of alleged offence. Surprisingly there is nothing on record to show that the said judgment had been challenged either by State or aggrieved person. Thereby acquittal judgment had attained finality. There is also the orders and judgment placed in the case file, which needs to be appreciated in the acquittal order of accused on separate sheet in said Sessions Case. After acquittal of accused from S.C No.696 of 2009, instant Cr.B.A of applicant/accused became infructuous and it is hereby dismissed accordingly.
