The plaintiff Shabbir Ahmed appeared. He was inquired regarding the status of co-plaintiff Shakeel Ahmed to which he replied that plaintiff Shakeel Ahmed has been died away being unmarried leaving behind the plaintiffs as legal heirs. Such amended title sheet has already been filed in present suit. Whereas in suit No.75 no such amended title sheet in respect of deceased plaintiff Shakeel Ahmed has been brought on record. As such plaintiff is directed to bring on legal heirs of deceased plaintiff Shakeel Ahmed by filing such amended title sheet in suit No.75/2012. The plaintiff further disclosed that apart from Shakeel Ahmed, co-plaintiff Aqeel Ahmed and Jameel Ahmed have also been died away. As such, the plaintiff side is required to satisfy the court whether he has filed amended title sheets in aforesaid both suits whether their legal heirs have been brought on record and whether he has filed amended title sheet in this regard or not. With regard to the fact of filing application U/o 01 rule 10 CPC in civil appeal No.38/2024 by one Mst: Nasreen through her legal heirs claiming herself to be daughter of Bashir Ahmed. In this regard, the plaintiff disclosed that the Mst: Nasreen was the daughter of Bashir Ahmed, the father of plaintiffs. Said Mst: Nasreen had been died away in the year of 1998. The plaintiff has denied that the applicants legal heirs of Mst: Nasreen namely Mst: Saira Bano and Ghulam Mustafa are legal heirs and they are entitled being shareholders in the suit property. As such the plaintiff is directed to file amended plaint by citing / arraying the legal heirs of deceased Mst: Nasreen particularly the applicants namely Mst: Saira Bano D/o Mst: Nasreen W/o Jaffar Hussain and Ghulam Mustafa S/o Sirajuddin as defendants, who filed application U/s 12 (2) CPC before the executing court by claiming themselves to be legal heirs of deceased Mst: Nasreen being necessary and essential party and claiming there are also shareholders in the suit property. Subsequently, said application U/s 12 (2) CPC was disposed of being infructuous in view of the order passed by Honourable Appellate Court/ Additional District Judge-II, Mirpurkhas in civil appeal No.06/2025 and 38/2024. With regard to the execution of power of attorney in favour of the plaintiff for filing the suits, by Mst: Samina the plaintiff No.08, in this regard she personally appeared before the Honourable Appellate Court, filed her affidavit therein and stated that she had never executed power of attorney in favour of the plaintiff Shabbir Ahmed and same is managed by plaintiff Shabbir Ahmed. In this regard, the plaintiff disclosed that Mst: Samina has executed power of attorney in his favour but now he has turned hostile and in league with the defendants. The plaintiff disclosed that he could not produce Mst: Samina to verify the execution power of attorney by Mst: Samina in his favour for the aforesaid reason. As such the plaintiff is directed to file amended title / plaint by citing the name of plaintiff Mst: Samina as defendant instead of plaintiff with regard to the appearing of special attorney of deceased plaintiff No.04 Aqeel Ahmed before Honourable Appellate Court and filing affidavit therein by expressing no objection if appeal No.38 /2024 was allowed. In this regard, the plaintiff disclosed that he has already filed amended title sheet and brought on record the legal heirs of Aqeel Ahmed but he disclosed that the Mst: Nasreen W/o Aqeel Ahmed is no more legal heir of deceased Aqeel Ahmed for the reason that she had been divorced as she herself got divorced from Aqeel Ahmed in the year of 2012. As such the plaintiff is directed to file amended plaint by citing Mst: Nasreen W/o deceased Aqeel Ahmed as defendant. The plaintiff is directed to file amended plaint / title in respect of aforesaid direction till next date, failing which any appropriate order shall be passed.
