From the perusal of record it transpires that this Court, vide order dated 25-10-2025, stayed the proceedings of the instant execution application in view of an interim order passed by the learned Appellate Court, i.e., learned Additional Sessions Judge-II, Mirpurkhas, in Civil Revision No.25 of 2025 (Sharif Muhammad Khan through L.Rs versus Abdul Khalique (deceased) through L.Rs and others) and connected Civil Revision No.26 of 2025 (Miandad Khan versus Abdul Khalique (deceased) through L.Rs and others). The said interim order clearly reflects that the operation of the impugned orders dated 10-03-2025 passed on Civil Misc. Applications No.02/2025 and 03/2025 in F.C. Suit No.319/2012, as well as the judgment and decree dated 24-04-2014, have been suspended/stayed till the next date of hearing by the learned Appellate Court. In consequence thereof, this Court had already stayed further proceedings in the instant execution application, as continuation of execution proceedings, in the presence of such stay order, would be contrary to law and judicial propriety. Today, neither any party has appeared nor any order from the learned Appellate Court has been placed on record showing that the interim relief granted by the learned Appellate Court has been vacated, modified, or recalled. It is a settled principle that subordinate courts are bound to adhere to and act in conformity with the orders passed by the superior courts. So long as the stay order remains in the field, this Court cannot proceed further with the execution application. Virtue of aforesaid position, the instant execution application is hereby adjourned sine die, subject to revival upon receipt of further directions or orders from the learned Appellate Court, i.e., learned Additional Sessions Judge-II, Mirpurkhas.

It is pertinent to mention here that no any intimation or adjournment been moved from defendant side either to post/ keep aside the matter during course of the day or to adjourned it to some future date as such the cross-examination of the said witness was declared Nil though chance extended to defendant side but none appeared from their side. Learned counsel for the plaintiff disclosed that examination in chief of witness Jamshaid was already recorded but now the said witness is reluctant to appear in the court as such he requested through statement that summon be issued to the said witness. Apart from that there is direction from Honourable Appellate Court passed in first Civil appeal No.03/2022 by Court of Honourable District Judge, Mirpurkhas to provide opportunity to defendant side for cross-examination to the plaintiff witnesses. Needless to say here that cross-examination of said witness was declared Nil at the time of recording his chief due to absence of defendant side however, keeping in view the directions of Honourable Appellate court and principle of natural justice and fair trial, let summon be issued to the said witness. Matter adjourned to 22-04-2026 for cross-examination of witness namely Jamshaid S/o Rasheed Ahmed. Both sides are directed to appear and proceed with the matter till next date failing which any appropriate order shall be passed against defaulting party.
