30-09-2026. Matter called. It is fixed for compliance in terms of order 10 rule 1-A(sub rule iii) section 89-A CPC and hearing on application U/o 39 rule 01 and 02 CPC. Learned counsels for defendant No.01, 02 and 03 appeared and disclosed that there is no any chance for settlement / compromise in between the parties in terms of order 10 rule 1-A(sub rule iii) section 89-A CPC. Hence, they requested to declare the proceedings order 10 rule 1-A(sub rule iii) section 89-A CPC as failed and claimed trial. The learned counsels for defendant No.01, 02 and 03 also advance their hearing on aforesaid application. The learned counsel for defendant No.02 and 03 argued that the defendant No.01 has sold out suit land to defendant No.02 and 03 and at present they are in possession of the suit land hence, defendant No.01 is no more necessary party. The learned counsel for defendant No. 02 and 03 argued that he will have no objection if the injunction is granted only to the extent of further transaction of suit land. On the other hand, none appeared from plaintiff side though matter called repeatedly. Virtue of aforesaid position, there appear no chance for any successful settlement / reconciliation in between the parties, therefore, the proceedings in terms of order 10 rule 1-A(sub rule iii) section 89-A CPC is hereby declared failed. Apart from that it appears that the application U/o 39 rule 01 and 02 CPC is pending since the institution of the suit hence, it is oldest one.
