The appellants Mann and others challenged the said consolidated Judgment by filing Civil Appeal No:105/2023 before Honourable Appellate Court and the said Civil Appeal later on allowed. Consequently, the aforesaid consolidated Judgment and decree were set-aside, the matter was remanded with direction to provide opportunity to defendants to examine marginal witnesses of agreement dated:20-10-2005 and afford proper opportunity to appellant to cross-examine them and to record fresh findings and Judgment in accordance with law, vide said Judgment dated:13-11-2025. The said Judgment was put before the undersigned and order was passed on it, ???Seen.
