Today, the matter was called and it is fixed for compliance/hearing on the point of maintainability of execution proceedings initiated by Muhammad Imran and others, who are otherwise Judgment Debtors (J.Ds). During the course of proceedings, the Reader of this Court pointed out the order dated 20-01-2026 passed by the learned Court of Honourable 2nd Additional District Judge, Mirpurkhas in Civil Revision No.53/2024. Through the said order, the learned revisional court has set aside the order dated 11-09-2024 passed by the learned predecessor of this Court on an application filed under Section 12(2) C.P.C by applicant Muhammad Yameen Abbasi, which had earlier been dismissed. The revisional court has directed this Court to decide the said application under Section 12(2) C.P.C afresh after framing of issues, recording of evidence and providing sufficient opportunities to the parties, strictly in accordance with law. Perusal of the record reflects that in the application under Section 12(2) C.P.C moved by the applicant Muhammad Yameen Abbasi, objections were filed only by Muhammad Imran, who is J.D No.01. No objections were submitted by the plaintiff/decree holder Muhammad Aslam or by the remaining J.Ds No.02 to 07. The record further reveals that service upon opponent No.01 (plaintiff/decree holder) was held good vide diary dated 06-11-2023, whereas service upon opponents No.05 and the official opponents was held good vide diary dated 22-11-2023. It also appears from the record that the opponent No.01 (plaintiff/decree holder) Muhammad Aslam as well as the official defendants were debarred from filing objections to the application under Section 12(2) C.P.C. Subsequently, the said application under Section 12(2) C.P.C was dismissed by this Court vide order dated 11-09-2024. Feeling aggrieved, the applicant preferred Civil Revision No.53/2024 before the Honourable 2nd Additional District Judge, Mirpurkhas, which has now been allowed and the impugned order dated 11-09-2024 has been set aside with specific directions to this Court to decide the application afresh after framing of issues and recording evidence. In view of the directions of the learned revisional court and in order to ensure compliance with the said directions as well as the requirements of law, it appears just and proper that the application under Section 12(2) C.P.C filed by applicant Muhammad Yameen Abbasi be proceeded with in accordance with the mandate of the revisional court. Accordingly, the matter be fixed for framing of issues on the application under Section 12(2) C.P.C. Let one time Court motion notices be issued to the plaintiff/decree holder, defendants and the applicant for their appearance and participation in the proceedings. Meanwhile, considering that the validity of the decree itself is under challenge in the application under Section 12(2) C.P.C, the execution proceedings are hereby suspended till the final decision of the said application.
