Today, the matter is fixed for further cross-examination of plaintiff by defendant side as very last and final chance and hearing on application U/o 14 rule 05 C.P.C. Learned counsel for the private defendants disclosed that the Judgment and decree passed in civil appeal No.95/2013 vide dated:20-12-2016 have been suspended by Honourable High Court of Sindh, Circuit Court Mirpurkhas in 2nd Civil Appeal No.S-80/2024 (Re: Abdul Hameed Through L.Rs Versus Muhammad Ashraf and others) vide order dated:09-03-2026. Hence, he argued that he will not conduct further cross-examination to the Plaintiff. He was directed to conduct the further cross-examination to the plaintiff but he refused and shown his unwillingness by saying that he will not conduct further cross-examination to the plaintiff by saying that the proceedings have been suspended by the Honourable High Court of Sindh in aforesaid matter which is directly connected with this matter. It is pertinent to mention here that the matter in which proceedings have been suspended by the Honourable High Court of Sindh, is a separate matter while this is a separate suit filed by the plaintiff. He read out the contents of order of Honourable High court of Sindh on his mobile phone but nowhere mentioned therein that proceedings in the instant matter have been suspended. It is pertinent to mention here that examination in chief of plaintiff was recorded on 25-08-2021; however, his cross-examination was reserved in the interest of Justice due to absence of defendant side. Thereafter, the first cross-examination of the plaintiff was conducted on 07-05-2024 and meanwhile the matter was adjourned sine-die by learned predecessor of this court on 07-05-2024. The record reveals that further cross-examination of the plaintiff was again recorded on 20-03-2024 and it was again reserved upon request of learned counsel for the defendant. Thereafter, the cross-examination was further recorded on 04-03-2026 and further cross-examination of the plaintiff was again reserved upon own request of learned counsel for the defendants but now the learned counsel for the defendants is reluctant to conduct further cross-examination to the plaintiff as he has clearly refused and shown his unwillingness to conduct and complete the further cross-examination to the plaintiff only on the ground as mentioned above. The ground for not conducting the further cross-examination, as taken by learned counsel for defendants seems to be illogical and meritless. In view of aforesaid position, further cross-examination of plaintiff is hereby declared Nil though sufficient chances extended. Arguments on application U/o 14 rule 05 CPC heard from respective sides let the matter be fixed for evidence of witnesses of plaintiff and order on application. As this court has been declared as Model Civil Trial Court for expeditious disposal of old chronic cases. The instant matter is also one of the old case. Therefore, in order to save time of the court, plaintiff side is directed to file affidavit in evidence of witnesses till next date. Later on learned counsel for the plaintiff along with the plaintiff appeared and filed application for adjournment by stating therein that his Civil Revision bearing No.15/2026 has been allowed by the Honourable Revisional Court on dated:02-03-2026 and order of this court dated:28-02-2026 has been recalled. He has annexed the copy of diary sheet/ case diary of the said revisional court printed from CFMS system which depicts that the revision has been disposed of in terms of the order. But copy of said order has not been produced/ procured by learned counsel for the plaintiff. In view of above said statement/ contention of learned counsel for the plaintiff, it appears that the above said civil Revision filed by him has been allowed hence, let the matter be fixed for cross-examination of defendant and her witnesses by the plaintiff side with clear directions to proceed with the matter till next date failing which any appropriate order shall be passed. It is clarified that the cross-examination of defendant and her witnesses shall be subject to the terms and conditions of the order of revisional court.
