Today this suit is fixed for Pre-Trial under Section 10(3) of Family Courts Act, 1964. Both parties are present, efforts for reconciliation made, during pre trial plaintiff/husband Muhammad Ramzan has filed application at Ex.11 stating that he has pronounced Talaq to defendant/his wife Mst. Mandhi today on 21-10-2026 before witnesses namely (1) Ahmed Khan S/o Allah Dino and (2) Mashooque Ali S/o Muhammad Ibraheem, he does not want to keep defendant as his wife and does not want to press his suit for conjugal rights. Defendant Mst. Mandhi present in court admits that Talaq has been pronounced upon her today in Court premises by plaintiff before above named witnesses, she accepts Talaq. So far as minor daughter Mst. Jamela aged about 02 months is concerned, plaintiff has shown his willingness to pay maintenance of minor daughter. Plaintiff will pay maintenance of minor daughter at the rate of Rs. 5000/- per month. Defendant accepts the said offer by way of consent, joint statement of both parties on record. In view of above, plaintiff Muhammad Ramzan has pronounced Talaq today on 21-10-2026 to defendant Mst. Mandhi before witnesses Ahmed Khan S/o Allah Dino and Mashooque Ali S/o Muhammad Ibraheem. The Talaq between parties is hereby held as pronounced. Suit of plaintiff for Conjugal Rights stands dismissed. Further minor daughter Mst. Jamela is entitle for her maintenance, plaintiff with consent accepted, plaintiff shall pay Rs. 5000/- (Rupees Five Thousand Only) per month as monthly maintenance to minor daughter from today i.e. 21-10-2026 till her legal entitlement. However per year increase not mentioned in consent statement but same is settled principle that in maintenance of minor with spent of time increase must be mentioned, therefore 10 % increase per years reckoned from date of this order. The maintenance shall be paid/deposited in Court by 10th of each month. No order as to costs. Let the decree be prepared accordingly.
