Criminal case/D.C called. Complainant is present. N.B.Ws issued against both accused persons returned un-executed. Complainant submitted statement from withdrawn from the DC at Exh.03. Both accused voluntarily appeared they submitted application at Ex-03 that out of court they patched up with complainant. Statement of complainant reveals that Nek Mards of locality as well as DDA Yasir Arfat Junejo at the office of president District Bar Association Mithi at Diplo, both nominated accused appeared made request to forgive, due to intervention of Nek Mards patched up between both parties. Now complainant does not want to proceed direct complaint and desire to withdraw. NBWs warrant issued against accused persons, despite of that both accused appeared before this court without obtaining pre arrest bail, and also complainant and accused persons despite of compromise not filed application U/s 345 Cr.P.C as per procedure, in accordance with law. The material fact reveals that both parties patched up out of court with intervene of Bar and now complainant wants to withdraw from instant direct complaint, therefore accused persons not taken into custody as this court pay Honor to decision of District Bar Association, complainant ready to withdraw from instant direct complaint. Section 248 CRPC provided powers to complainant to withdraw from complaint, with satisfaction of court. In present direct complaint section 384, 385, 506(2), PPC are non compoundable but apart from that while complainant not ready to proceed with matter, thereby permission granted to complainant to withdraw. Order passed at Exh.04 and announced in open Court, As per order, instant direct complaint is withdraw and both above named accused persons are acquitted from all charges.
