Since both FIRs arise out of the same occurrence between the same parties at the same time, the Investigation Officer has rightly recommended disposal of fIR No. 68 /2025 under C Class, therefore the said report is hereby accepted ,whereas the supplementary challa under FIR No. 67/2025 is accepted and the same be sent to Honourable trial Court, FIR No. 68/2025 stands disposed of under C Class .The accuse present on bail in this case are discharged and their bail bonds are cancelled with surties discharged. The cognizance is taken in FIR No. 67/2025 against all the above named accused persons for offences punishable under sections 324, 147,148,149,114, 504, and 337-F(vi) PPC leaving the determination of aggressor and culpability to be decided at trial on the basis of evidence . Since the offence under section 324 PPC is exclusively triable by the Court of Sessions and this case arising out of fIR No. 67/2025 be sent to the Court of Honourable Sessions Judge ,Tharparkar at Mithi ,after completion of all codal formalities. .Both parties are directed to appear before the Court of Honourable Sessions Court Mithi on 13.4.2026 for further proceedings .
