Learned counsel for the plaintiff has filed an application for condonation ..........at Ex.07. Order passed thereon. Learned counsel for the plaintiff pressed the application under Order XXXIX Rules 1 and 2 CPC by asserting urgency and contended that defendant No.01 is deliberately withholding his objections thereto, he submitted that defendant No.01 is attempting to create third-party interest in the suit agricultural land by leasing out the same in favour of another person without associating the plaintiff, who is stated to be his brother and co-sharer. The submissions may be worth consideration. However, before any adverse or coercive order is passed on the basis of the aforesaid claims, it is expedient that defendant No.01 be afforded an effective opportunity to respond. Having regard to the requirements of fair opportunity, it would be appropriate to afford defendant No.01 a short but meaningful opportunity to respond to the allegations. Court is lying vacant.
