17-09-2026. Matter called. It has been recently transferred from the court of learned Senior Civil Judge-III, Mirpurkhas upon administrative ground / order passed by Honourable District Judge, Mirpurkhas for its expeditious / meritorious disposal in accordance with law. It is fixed for plaintiff side evidence. The record reveals that instant suit was filed in the year of 2023. The applications U/o 39 rule 01 and 02 CPC and U/o 07 rule 11 CPC were repeatedly fixed to a number of dates more than 39 hearing despite of that parties from both sides failed to proceed with the applications consequently said applications were dismissed in non-prosecution vide order dated:03-08-2026. Issues were framed on 27-08-2026 and matter was fixed for plaintiff side evidence on 17-09-2026 today. Today, matter has been called repeatedly since morning but none appeared from either side, no intimation or adjournment been moved from either side. However, it would be appropriate that in the interest of Justice one time court motion notice issued including pasting to plaintiffs and defendants including their counsels with direction to appear and proceed with the matter without fail otherwise appropriate order shall be passed. Matter adjourned to----------24-09-2026 for plaintiff side evidence. Office is directed to issue one time court motion notice including pasting on plaintiff and defendants and their counsels. |
