Accordingly, they are found guilty of offence punishable U/s 201 PPC and are therefore convicted U.s 265-H (ii) Cr.P.C.??The offence of pertaining to murder of deceased namely Jibran carried capital punishment therefore in the light of provisions of section 201 PPC each of the accused 1. Inspector Noor Mustafa, 2. ASI Ghulam Qadir Gopang, 3.HC Dost Muhammad, 4.HC-3241 Abdul Sattar, 5. PC 3397 Ghulam Mustafa, 6. DPC Ghulam Mustafa, 7. ASI Nazeer Ahmed Panhwar, 8. PC-2250 Allah Bachayo, 9. PC-2124 Imran Ali are sentenced to RI seven years each and to pay a fine amount of Rs. 10,000/- each. In default of payment of fine amount, they shall undergo S.I for three months each. ??So also, in the light of provisions of 544-A Cr.P.C for causing mental anguish and psychological damage to the legal heirs/relative of the deceased, as reflect from the evidence of legal heirs/relative recorded at trial, ??they are also liable to pay compensation to the legal heirs of deceased. Accordingly, Inspector Noor Mustafa shall pay an amount of Rs.1,000,000/- (ten lacs) while remaining convicted accused shall pay an amount of Rs.100,000/- each as compensation. Dairies show that accused ASI Nazeer was being produced from jail therefore benefits of section 382-B Cr.P.C shall be extended to him by the jail authorities.??Accused are present on bail they are taken in to custody, and remanded to jail with conviction warrant and slip to serve out his sentence. After execution of sentence, same shall be certified to this Court in the light of section 400 Cr.P.C.??Note: As soon as this judgment was pronounced, the convicts managed to escape from the court room. The case of absconder accused Tahir alias Doda is kept on dormant file. SURETY ORDER. 08.01.2026. Since the accused runaway soon after announcement of judgment from the courtroom therefore, surety order could not be passed, then, no penalty lies upon the sureties to be penalized or be proceeded. However, since sureties cannot be burdened, they having decamped from court premises as such stands discharged. Accused Irshad Cheema was also acquitted therefore his surety is hereby discharged and bail bonds stands canceled.?????? |
