Today case was fixed for charge however, on careful perusal of the material available on record and after hearing the learned ADPP, detailed order passed on separate sheet and announced in open court. As per final report and the material available on record Section 377 PPC has been inserted/added in the challan which is scheduled offence under the Anti-Rape (Investigation & Trial) Act, 2021 and whereas, according to Section 9(6) of the Act, Ibid final report under Section 173 Cr.P.C is to be placed before the designated Special Anti-Rape Court hence, by exercising revisional jurisdiction conferred to this court under Section 439-A Cr.P.C order of the learned Civil Judge & J.M-I, Matiari dated:23.09.2026 of accepting challan only for offences under Sections 302, 201 PPC is hereby set-aside and the R & Ps of the case are hereby assigned to the court learned Additional Sessions Judge, Matiari being designated Special Anti-Rape Court for passing order on the final report afresh for trial and disposal of the case in accordance with law. |
