Suit called. Attorney of plaintiffs as well as counsel are present. Attorney of private defendants present, however his counsel called absent. While remaining defendants are called absent. Learned DDA is present on behalf of official defendants. Today application U/O 14 rule 5 fixed for order. Order passed and announced in open court. Learned counsel for both the parties also conceded that there is no much difference between the issue No.3 already framed and the new proposed issue No.3, however, they agreed that they will be satisfied if the word ???was??? is inserted after the word ???plaintiff??? in the earlier framed issue No.3. The learned counsel for plaintiff also filed statement in this regard dated 11.11.2025 to which no objection is endorsed by the learned counsel for defendants No.1 to 7. In view of above, there requires no reframing of issue No.3 as proposed in the instant application, which is hereby declined, however, in exercise of powers U/S 151 and 153 CPC, it is ordered that the word ???was??? may be inserted after the word ???plaintiff??? in the earlier issue No.3 with red ink. ince, there has happed no change in the version of the parties or controversy in terms of above correction in the issue No.3, therefore, there remains no need of calling fresh evidence, therefore, let the matter be proceeded further from the stage when the instant application was filed.
