Case called. Accused Kambeer @ Paharuddin is present on bail, while accused Shikari @ Sikandar, Akbar @ Akoo, Mehrab, Irfan, Riaz, Muneer and Ali Muhammad are shown as absconder in challan sheet and declared as proclaimed offender. Summonses were issued to the complainant and her witnesses on several times, but they did not appear despite being served, including the investigator. In spite of the fact that the complainant was given a fair opportunity to record her evidence at the trial, and this court had also issued compelling processes against her and other witnesses, the complainant did not appear interested in pursuing her case further. In fact, the court had waited for long, so it gave the prosecution a fair chance to record their evidence, but sadly, they did not. In these circumstances, this court had no choice but to stop the case proceedings under section 249 Cr.P.C against the present accused. It is pertinent to mention here that the case against other accused persons was already kept on dormant file. However, the complainant can open her case subject to the production of her other witnesses in future.
