Learned counsel for the defendant No.1 appeared and submitted application u/s 151 CPC for recalling the order dated 05.09.2026 on the ground that the defendant No.1 did not appear on the day of hearing on the application for leave to defend due to serious ailment and bad rest. On the other hand, the learned counsel for the plaintiff ready to straightway argue on the application in hand by endorsement on the application. By considering the statement of the surety, the application in hand is hereby allowed and the suit is restored to its original stage, as it stood prior to passing of order dated 05.09.2026. In the larger interest of justice, application U/O XXVIII Rule 3 CPC and leave to defend is hereby allowed subject to furnishing surety to the tune of Rs.101,000/- on or before the next date of hearing i.e. 22.10.2026. for hearing on application leave to defend. |
