Learned counsel for the plaintiff disclosed that previously the instant suit was filed through attorney but subsequently the plaintiff/ executant namely Abdul Jabbar was died away. Hence, he filed fresh power of attorney of legal heirs in the name of legal heir Abdul Qadir of deceased plaintiff vide such statement dated:31-01-2023 hence he prayed that permission be granted to bring on record such power of attorney to proceed with the matter. Chance of hearing extended to defendant side but the learned counsel for defendant No.01 is called absent. As the matter appears to be oldest one of the year of 2017 and this court has been designated as Model Civil Trial Court for expeditious disposal of old chronic cases. Virtue of aforesaid position, permission granted in the interest of Justice and in order to save previous time of the court. Thereafter, learned counsel asked to lead the evidence as the attorney is also present in the court but he requested for grant of time for want of preparation. Request considered. F.C suit called. L.R of plaintiff No. 1(f) Abdul Qadir is present. Learned counsel for L.Rs plaintiff Mr. D.K Malhi advocate is present. Defendant No.01 Nawaz Ali is present. Learned counsel for defendant No.01 Mr. Shahnawaz Laghari advocate called absent. Perusal of record reflect with regard to conduct of the plaintiff side during the proceedings dated 29-04-2026 to 11-05-2026. It appears that the matter was repeatedly fixed for plaintiff side evidence; however, the plaintiff side consistently failed to avail the opportunities granted by this Court. On 29-04-2026, the matter was called repeatedly throughout the day at different times, neither the plaintiff nor his learned counsel appeared before the Court. No intimation, adjournment application, or request for pass over was moved on their behalf. The absence was complete and unexplained, despite the fact that the matter was specifically fixed for evidence. On 30-04-2026, once again the plaintiff and his witnesses remained absent. Learned counsel for plaintiff did not appear in person; rather, adjournment request was conveyed through office staff on the ground of his engagement before the Board of Revenue, Hyderabad. Though the request was considered, it was noted that no particulars of the alleged engagement were furnished. Nevertheless, in the interest of justice, the matter was adjourned with direction to the plaintiff side to ensure production of evidence on the next date. On 04-05-2026, the plaintiff side again failed to appear before the Court. Neither the plaintiff, nor his witnesses, nor his learned counsel attended the proceedings. Despite earlier caution and repeated indulgence granted by the Court, no effort was made by the plaintiff side to prosecute the matter. Still, one more opportunity was extended in the interest of justice. On 07-05-2026, again none appeared on behalf of the plaintiff side. No explanation or application for adjournment was submitted. The matter was nevertheless adjourned in view of administrative instructions, with a clear direction that plaintiff side shall positively proceed with evidence on the next date. On 11-05-2026, the plaintiff remained absent, though learned counsel for plaintiff appeared and moved adjournment application on the ground of rush of work. The same was allowed as a final indulgence, and it was specifically made clear that the matter would proceed without any further adjournment and that both parties were required to remain vigilant. Despite the aforesaid repeated indulgences and clear directions, on the next date of hearing the plaintiff side again failed to appear. Record further reflects that the conduct of the plaintiff side reflects persistent negligence, continuous non-appearance, and deliberate disregard of repeated directions of this Court. Despite having been afforded multiple opportunities, the plaintiff side failed to remain diligent in prosecuting the matter. Virtue of aforesaid position, matter adjourned in the interest of Justice. Plaintiff side is strictly directed to appear and lead their evidence as last and final chance. Today learned counsel for plaintiff filed application for adjournment at ex.NO.79,order on it, Allowed. Matter adjourned to------------20-05-2026 for plaintiff side evidence, failing which any appropriate order shall be passed against defaulting party. |

04-05-2026. Matter called. Plaintiff and his witnesses called absent. Learned counsel of plaintiff also called absent. Learned counsel for the defendant no.01 is present. The perusal reveals that issues were framed on 21-05-2018 since then more than 07 years has passed but not a single plaintiff witness including the plaintiff been examined. Same position was observed on 29-04-2026. On 30-04-2026, none appeared from plaintiff side while learned counsel for plaintiff sent adjournment application which was granted with direction to produce plaintiff and witnesses along with documents for recording their evidence till today with caution that failing which any appropriate order shall be passed. Despite of such caution and clear directions, the defendant side has again not bothered to appear and get record their evidence. Such conduct is not worth appreciating rather inviting the court conscious to pass any adverse order nevertheless, this court has again observing restraint and adjourned the matter. Let the matter be adjourned to 07-05-2026 for plaintiff side evidence as very last and final chance failing which any appropriate order shall be passed. |

This case received to this Court by way of transfer from the Court of learned Senior Civil Judge-III, Mirpurkhas, in compliance of order of Honourable District 7 Sessions Judge, Mirpurkhas vide letter bearing No. 1570 dated 08-4-2026. F.C suit called repeatedly since morning but none appeared so also no intimation or adjournment been moved from either side. Nevertheless, mater posted several times during course of the day but none appeared from both sides. Matter per diaries is fixed for plaintiff side evidence. No any witness including plaintiff and his counsel appeared during course of the day. The record reveals that issues were framed on 21-5-2018 since then more then 07 years been passed but not a single witness from plaintiff side has been examined. Today, smae position been observed from plaintiff side as none appeared in this regard.
