Case called. Accused is present on bai. Learnedd ADPP is present. Order passed and pronounced in open Court. Perusal of the R&Ps sent up by the learned Civil Judge & J.M-I Matiari shows that cognizance of Section 324 PPC was taken and R&Ps were sent up on the ground that offence punishable under section 324 PPC is exclusively triable by the Court of Sessions. Perusal of the police papers shows that during the commission of offence neither accused used their weapons, nor any person sustained injury which is one of the ingredients to invoke offence punishable under section 324 PPC. The record further shows that ingredients of Section 324 PPC are not attracted to this case. The R&Ps of the above mentioned case is hereby transferred to learned Civil Judge & Judicial Magistrate-I Matiari to try and proceed with the case in accordance with the law. Accued is directed to appear before transferee Court. |
