Session case called. All 04 accused namely 01. Allah Bachayo, 02. Maqbool Ahmed, 03. Qurban Ali and 04. Moolo are present on bail. Mr. Hemoon Kolhi learned ADPP for state is present. Mr. Zaheeruddin Nohri learned advocate is present and he has filed his vakalatanama on behalf all accused. Complainant namely Harsingh is present. Mr. Jeeloji learned advocate is present and he has moved application U/S 493 Cr.P.C for grant of permission to assist the prosecution alongwith his Vakalatanama on behalf of complainant. Both parties moved a joint application U/S 345(2) Cr.P.C at Ex-02. Order passed on it. Notice to DPP. Copy of the same is supplied to ADPP. Both parties also moved an other joint application U/S 345(6) Cr.P.C along with affidavits of complainant namely Harsingh at Ex-03. Order passed on it. Notice to DPP. Copy of the same is supplied to ADPP. ADPP has given no objections on both applications Ex-02 & Ex-03. Arguments heard from both side. Order passed on separate sheets at Ex-04 & Ex-05 and announced in open court whereby applications Ex-02 & 03 are allowed and all the above named 04 accused are acquitted U/S 345(6) Cr.P.C. They are present on bail, their bail bonds stand cancelled and surety is discharged. |
