In view of above stated detailed discussion on the above point and the result thereof, since the prosecution has successfully proved its case against accused namely Atta Hussain for possessing an unlicensed rifle of .44 bore which was used by him in murdering of innocent deceased namely Mureed Hussain along with other accused and causing injuries to injured Abdul Fattah. Therefore, under such circumstances he deserves punishment. Accordingly, while I exercising powers so conferred upon me under section 265-H (ii) of criminal procedure code and convict the accused above named for an offence punishable under section 25 of Sindh Arms Act 2013 and he is sentenced to undergo R.I for 07 years and to pay fine of Rs. 50,000/- (rupees Fifty Thousand only). In case of failure in payment of fine, the convict accused shall undergo six months more simple imprisonment. He remained in jail since his arrest viz.03.05.2023, therefore, he is given benefit under section 382-B of Criminal Procedure Code. Let PDF copy of Judgment is provided to him free of costs, through Video link. He is present in Court from jail through Video Link and Jail authorities are directed to keep continue his custody for serving out the sentence so awarded to him in accordance with law. Let the conviction slip be sent to jail authorities accordingly. 26.?? It is pertinent to mention here that the accused Attah Hussain has also been awarded life imprisonment in main murder case being crime No.76 of 2023 under sections 302,337A(iii), 337-H-II, 148/149 PPC vied judgment dated: 29-04-2026, both the sentences in cases will run concurrently.
