Case called. All accused persons namely Jalal, Muhammad Khan and Muhammad Uris are already declared as proclaimed offenders. Learned ADPP for the state is present. Today case is fixed for Service. Process viz. Notice to surety against all accused persons was returned un-served alongwith Statements of two witnesses namely Muhammad Abbas and Lal Muhamamd as well as entry No.20 of PS Shahpur. Order passed on separate sheet. The impose penalty on surety namely Pardeep s/o Hamtharam in the sum of Rs.60,000/- being the amount of bond executed by him. He is directed to pay this amount within 30 days from today, else failure to deposit, surety amount deposited will be forfeited accordingly and in such situation reader of the court is directed to encase the surety amount and deposit the same in government treasury as per law. Heard and perused. Order passed on separate sheet. Since the accused persons named above have been declared proclaimed offenders and there is no likelihood of their arrest in near future. All the efforts of this court would be futile and meaningless, if the case proceeded further. Hence there is no alternate except to keep the case on dormant file. Therefore, it is ordered under para 2(2) of the Part A of the Chapter VI of the federal capital and Sindh Criminal Circular the case may be dropped from the regular file and be kept on the dormant file till the accused are arrested and brought before this court. |
