Heard the arguments on Application U/o VII Rule 11, Application U/O. 39 Rule 1 &2 CPC as well as Application for consolidation of suits. Order passed on the separate order sheets. The Application U/O. VII Rule 11 CPC stands dismissed. The Application U/O. 39 Rule 1&2 CPC is partly allowed accordingly. The defendants are restrained from dispossession the plaintiffs from the suit property. Furthermore the defendants are restrained from transferring, selling and creating any third party interest in respect of the suit property. The temporary injunction is granted for the six months or final disposal of the case whichever is earlier in time. Whereas the injunctive relief to the extent for restraining orders against the defendants to collect rent from any tenant and issuing threats as well as no raising construction over the suit property is declined. The application for consolidation of both suits stands allowed. Let suit No.157/2024 be treated as leading suit and Suit No.8597/2025 be treated as consolidated suit. Case is adjourned to 06.01.2026 for filling of proposed consolidated issues and settlement of issues as well as C/A on Application U/S 151 CPC for restoration of utilities filed by the defendant/plaintiff in Civil Suit No.8597/2025. |
