Case called. Plaintiff and learned counsel for the plaintiff are called absent. Order passed on separate order sheet. The perusal of record shows that the matter is fixed for service upon defendants since 31.05.2025, but plaintiff failed to get service upon the defendants as per directions vide order dated 31.05.2025 passed by this court. Further it appears that plaintiff has failed to deposit the costs for service nor obtained time for payment of cost. It appears that plaintiff has lost interest to proceed the matter against the defendants and made default to comply the directions of this court since last various dates of hearing. In view of upshot circumstances and reasons, I have no other alternate but to dismiss the suit of plaintiff due to non-prosecution and default under order 9 Rule 2&3 CPC in the interest of justice. Order accordingly. |
