Matter called. Learned counsel for the plaintiff is present and filed application U/S 52 of Transfer of Property Act. Notice to defendants side. Mr.Muhammad Younus Bhutto advocate filed Vakalatnama on behalf of defendant No.1 and 2 which is kept on record and received copies. None is present from rest of defendants side. Process through Bailiff returned served. The service is held good upon all defendants. Order passed on separate order sheet. Therefore, parties are directed to maintain status-quo till next date of hearing. Moreover, the Nazir is appointed is Commissioner to conduct the inspection in order to ascertain as to whether the plaintiff was remained in possession of suit property from the date of filing the suit till 02.07.2026. Nazir is required to record the statements of the neighbouring shopkeepers and also seek assistances from the officials of the market committee. Nazir is further directed to conduct the inspection in presence of both parties by issuance of proper notices. Nazir fees is fixed at the rate of Rs.20,000/- which shall be borne by the plaintiff. Put off to 14.07.2026 for filing written statement and Counter Affidavit as well as hearing on application U/O 39 Rule 1 & 2 CPC and also compliance report.
