R & Ps of instant case received by this Court from Honourable Sessions Judge, Kashmore @ Kandhkot on admninistrative ground by way of transfer for its disposal according to law. The matter is already fixed for today, therefore, called. All the accused namely Nozhan, Hidayatullah, Ilimuddin, Wahid, Bashir, Nazir @ Lutra, Sadam Hussain, Gulab and Nasarullah @ Siraj Ahmed are present on bail. Mr.Gahi Khan Bangwar, learned ADPP for the State is present. Mr.Muhammad Yaqoob Dahani, learned advocate for accused is present. No P.W is present. During the course of proceedings, it has been brought to the notice of this Court through case diary dated 26.01.2026 of the learned Magistrate that one of the accused, namely Nasarullah @ Siraj Ahmed s/o Hidayatullah Sundrani, is a Juvenile as defined under the Juvenile Justice System Act (JJSA), 2018. Heard. Order passed in a separate sheet, signed and announced in open Court at Ext.6. For the reasons to be recoded, the case of accused Nasarullah @ Siraj Ahmed Sundrani is hereby ordered to be bifurcated/separated from the main case involving the adult accused persons. The office/Reader of the Court is directed to prepare a separate case file in respect of the juvenile accused Nasarullah @ Siraj Ahmed, place attested photocopies of the FIR, Charge Sheet (Challan), and all relevant documents (under section 161, Cr.P.C and 173 Cr.P.C) in the newly created file. The main case against the remaining adult accused shall proceed on its own merits. The trial of the juvenile accused shall henceforth be conducted in accordance with the specialized procedures laid down in the JJSA 2018, ensuring the privacy and rights of the child as per law. Let charge against juvenile accused be framed. The charge against the adults accused namely Nozhan, Hidayatullah, Ilimuddin, Wahid, Bashir, Nazir @ Lutra, Sadam Hussain, Gulab framed at Ext.7, their pleas were also recorded at Ext.7/A to 7/H respectively, to which they pleaded not guilty and claimed for trial.
