Case called. Order passed thereon, ''...it appears that in the first instance the DH/Society must have adopted the relevant byelaws, rules and regulations for the sale of the building/suit property whenever it is sold out then the new purchaser / buyer may adopt the procedure of getting the vacant possession from the tenants provided under Section 18 of SRPO, 1979. The DH/Society had also the option of filing the rent petition against the respective tenants, if so advised on the ground provided under Section 14 & 15 of SRPO, 1979. In the light of above circumstances, I am of the considered opinion that the DH/Society had not obtained the possession of the respective shops in accordance with law, as such the DH/Society is liable to restore the same to the respective tenant of either shops or flat. Moreover, the DH/Society is also hereby restrained from getting the vacant possession of the other shops / flats from the remaining tenants except with due course of law. All the remaining applications stand disposed of in above terms except the application under Section 12(2) of CPC of Muhammad Younus, which shall be decided after filing of counter affidavit by the Society. Order accordingly.'' Let the matter be fixed on 17-05-2025 for filing counter affidavit by the society. |
