F.C Suit No.71/2023 being leading and subsequent thereto are F.C Suit No.84/2023 and F.C Suit No.57/2024 are called. Plaintiff of leading suit Abdul Rasheed is in attendance without attendance of is counsel; when confronted qua the witnesses he submitted that he was never asked by either to produce the witnesses. On the other hand, an application dated 19.09.2025 is on record whereby he sought time to produce witnesses. Besides that, his counsel on last date of hearing viz.31.10.2025 sought further time due to absence of the plaintiff. Additionally, consolidated issues have already been framed on 23.05.2025, but till date, not a single witness has been examined on his behalf. In attending circumstances, it is sufficely hold that plaintiff of leading suit Abdul Rasheed has lost his interest to proceed with the matter. Accordingly, this Court finding no alternative except to close the side of plaintiff of leading suit having F.C Suit No.71/2023 and defendants in F.C Suit No.84/2025, same is accordingly closed. Let the matter be fixed for defendants??? evidence of leading suit as well as plaintiffs in subsequent suits. Matter is put off to 28.11.2025.
