Criminal Misc Application called. Applicant and her counsel are present. Process issued same is returned served. SHO of PS Perunal recovered detainees and produced before this Court through ASI Ghulam Nabi along-with report and memo of recovery of detainee. Respondent No. 1 to 4is voluntarily appeared. Mr. Muhammad Faizan advocate appeared and filed vakalatnama on behalf of respondents. Order on it. File. Statement of detenee Faiza Batool is recorded. Arguments heard. Order passed and announced in open Court. The Detainees namely (1) Baby Zahra Batool (2) Saqib Ali and (3) Aqib Ali produced Before this Court are attached with their father/respondent No.04 and despite efforts taken byis court are not ready to with applicant. The detainee namely Faiza Batool is ready to go with her mother, therefore, the custody of minor Faiza Batool is handed over to the applicant/mother. The respondent No.4 shall be personally liable for the life and limb of detainees (1) Baby Zahra Batool (2) Saqib Ali and (3) Aqib Ali, while the applicant shall be personally liable for the life and limb of detainee Faiza Batool. The application in hand stands disposed of however, the applicant and respondent No.04 are at liberty to approach the court of Guardian and Wards Act having jurisdiction for custody of her child/detainee, if she desire so. This Criminal Misc; application stands disposed of accordingly. |
