The matter was perused in light of case diaries and fixed for further evidence on the part of the defendant, if any. It is pertinent to mention that the matter was called repeatedly since the morning, and despite sufficient opportunity, none appeared on behalf of the defendants except the court clerk. The clerk did not intimate the court regarding the intention of the defendant side, whether to produce any witness or to move an application for adjournment. No adjournment application or intimation has been filed by the defendant side, either to fix the matter during the course of the day or to adjourn it. The matter relates to the year 2019 and is therefore of an old nature. Considering the above position, it appears that the defendant side has no further witness to produce. Further, in the absence of any intimation or application for adjournment, the court could not wait indefinitely without any valid reason.
