15-10-2026. Matter called in morning. It is fixed for cross-examination of plaintiff side with direction to both sides to proceed with the matter by next date (today), failing which appropriate order shall be passed against defaulting party. Learned counsel for plaintiff is present since morning. The plaintiff and his witness are also present since morning but learned counsel for defendant failed to appeared. In this regard, Associate of learned counsel for defendants appeared and requested kept aside the matter during course of the day. His request was considered and matter was kept aside during course of the day. The court waited for defendant side till 12:05 noon time and again call the matter. At this time, the learned counsel for the defendants again called absent. His Associate appeared and filed application for adjournment at Ex:51 on the ground of illness of learned counsel. No details of any illness mentioned in it. No any prescription of concerned Doctor been annexed with it. Such conduct of defendant side is not worth appreciating nevertheless, application for adjournment of defendant side is granted subject to cost of Rs.500/- to be deposited in District Court Dispensary on proper receipt. Matter adjourned to--------------21-10-2026 for cross-examination of plaintiff and his witness by defendant side as last and final chance. Application for adjournment disposed of in above terms. |

08-10-2026. Matter called repeatedly. Learned counsel for plaintiff, plaintiff and his witness appeared. None appeared from defendant side except Associate of learned counsel for defendants who too marked attendance and went away without requesting to fix the matter during course of the day or to adjourn it. Nevertheless, matter was kept aside during course of the day and thereafter, it was called several times, it is 01:05 P.M but none is in attendance from defendant side. On the other hand, learned counsel for plaintiff, plaintiff and plaintiff witness is present. Such conduct of defendant side is not worth appreciating nevertheless, matter once again adjourned with direction to defendant side to proceed with the matter till next date, failing which any appropriate order shall be passed.
