Case Called. Learned counsel for plaintiff is present and partly heard. While junior counsel for defendant Nos.1 & 2 intimated that his senior counsel is out of station, therefore, on his request the hearing on application is adjourned. It is on record that the defendants have filed only counter affidavit on application under Order XXXIX Rule 1 & 2 CPC on 13-08-2024 but not filed written statement despite directions. Hence defendant Nos.1& 2 are directed to file their W.S on next date of hearing as a last and final chance. In the interest of justice matter is adj. to 02-10-2025 for filing W.S. as well as hearing of CMA 9651/24 application u/o 39 rules 1 & 2 CPC with strictly directed to file written statement as per law on the next date of hearing otherwise Court will proceed the matter as per available record and pass an appreciate order. |

Case Called The matter is fixed for hearing of applications Plaintiffs counsel is present since morning for hearing on applications on the other side.the junior counsel for defendant Nos.1 & 2 intimated that his senior counsel is busy before Honorable High Court of Sindh on his request the hearing on application was adjourned and the matter was fixed for filing of written statement till 12.00 pm again matter was taken up at 12.00 am but the counsel for defendant Nos 1 & 2 has not filed written statement as per law. further from the perusal of record shows that the defendants have filed counter affidavit on application under Order XXXiX Rule 1 & 2 CPC, on 13-08-2024. but not filed written statement defendant Nos.1& 2 are strictly directed to file written statement as per law on the next date of hearing otherwise the Court will pass an appreciate order. The Matter is adjourned on 02-09-2025 for filing of written statement as well as hearing of application juder Order XXXIX Rule 1 & 2 CPC. |

Case called. Learned counsel for plaintiff is present and stated that matter was fixed before Hon'ble High Court of Sindh on initial stage of service. He also filed receipts a/w confirmation report of courier service. Learned counsel for defendant Nos.1 & 2 is also present. Rest of defendants are absent.
