15-05-2026. Matter called. Learned counsel for decree holder and decree holder are present. None appeared from J.D side. Matter per diaries is fixed for order on reply of show cause notice. Perusal of record reveals that the decree holder side has filed for issuance of warrant of arrest against J.Ds No.01 to 03 for non-compliance of decree/ none payment of decretal amount. Perusal reveals that J.D No.01 is lady / women namely Mst: Shazia D/o Nazeer Ahmed. As per section 56 CPC, 1908 there is clear prohibition regarding arrest or detention of women in execution of decree for money. As such, the learned counsel for decree holder is directed to satisfy the court as under which law the warrant of arrest can be issued against lady / J.D. Apart from that it appears that J.D side has failed to receive the copy of warrant of arrest and to submit its reply/ its objection despite of the fact that said application was filed on 22-09-2025 as such the J.D side is directed to receive the copy of application of issuance of warrant of arrest filed by decree holder side and to submit its reply/ objections till next date failing which any appropriate order shall be passed. Put up to---------22-05-2026 for hearing of learned counsel to satisfy the court as under which law/ prohibition the women J.D can be ordered to be arrested in money decree as well as J.D side to submit reply / objections of application for issuance of warrant of arrest. |
