The record suggests that Plaintiffs filed Suit for recovery of Rs.52,07,730/=, declaration and permanent injunction and damages against Defendant No.1. This Court vide Judgment & Decree dated 23.01.2021 decreed the suit of Plaintiff. Thereafter, Plaintiff filed Execution Application No.08/2021, which was allowed vide Order dated 18.03.2023, whereby Defendant No.1 was directed to deposit Rs.52,07,730/= with 6% markup per annum to the Plaintiff till satisfaction of decree. The Plaintiff was required to submit list of moveable and immoveable properties for satisfaction of decree. Thereafter, matter was continuously fixed for compliance but none appeared from either side nor compliance of Court order is made. In view of above, the execution application is adjourned sine die till further orders. |
