Case called. The matter is fixed today for cross-examination of the plaintiff. However, the plaintiff is called absent without any intimation, despite the clear order dated 02.10.2026, whereby the parties were directed to appear on the next date of hearing, failing which Court will pass the order against the defaulter/violator without fail. as per Order VIII Rule 13 C.P.C., the defendants were bound to submit a list of their legal heirs with complete addresses along with the written statement, mentioning as to who shall intimate the Court in case of death, but the defendants have violated the said provision as well as Order XXII, Rule 4 C.P.C. Defendant No.1(ii) is son of defendant No.1(i) and brother of Defendant No.1(iii), which clearly shows that they have knowledge regarding pendency of the suit and its proceedings, but despite that, they are avoiding to appear before the Court. As per record, service upon Defendant No.1(i) & (iii) has been held good. In the larger interest of justice, the matter is again adjourned to 13.10.2026, with fresh directions to both parties to appear before the Court for cross-examination of the plaintiff. It is made clear that, in case of non-appearance of the plaintiff on the next date of hearing, the suit will be decided u/o VII Rule 3 CPC. In case of appearance of the plaintiff and non-appearance of the defendant, the defendant will again be debarred from cross-examining the plaintiff, and the side of plaintiff will again be closed. Put off to. 13.10.2026, for further proceedings. |
