31-10-2026. Matter called. It is fixed for cross-examination of plaintiff and his witnesses by defendant side and further evidence, if any. The plaintiff and his witnesses are present since morning but none appeared from defendant side. The record reveals that the examination in chief of plaintiff was recorded on 26-09-2026 but his cross-examination was reserved due to absence of defendant side, per record evidence of plaintiff witnesses was recorded on 01-10-2026 but their cross-examination was reserved due to absence of defendant side. Since then several chances been extended to defendant side for conducting cross-examination to the plaintiff and his witnesses but defendant side has not bother to conduct the same despite of availing several chances. Same position has been observed today as none appeared from defendant side. No intimation or adjournment filed by defendant side. Such conduct is not worth appreciating. However, matter once again adjourned to---------05-11-2026 for cross-examination of plaintiff and his witnesses subject to cost of Rs.1,000/- to be deposited by defendant No.01 in district court dispensary on proper receipt till next date without fail and filing of objections on the injunction application by the defendant side. |

24-10-2026. Matter called. It is fixed for cross-examination of the plaintiff and his witnesses by the defendant side, further evidence of the plaintiff???s witnesses, if any, and filing of objections on the injunction application by the defendant side. None appeared on behalf of either side, despite the matter being called repeatedly since morning. No intimation, or was any application for adjournment moved by either side seeking adjournment or requesting that the matter be fixed during the course of the day. Such conduct of both sides is not worth appreciating. Virtue of the aforesaid position, matter adjourned, with direction to the plaintiff side to appear and proceed with the matter till next date. Matter adjourned to------------31-10-2026 for cross-examination of the plaintiff and his witnesses by the defendant side, further evidence of the plaintiff???s witnesses, if any, and filing of objections on the injunction application by the defendant side.
