Matter called. Accused Lal Khan has appeared before the Court along with his advocate. Learned D/c has furnished a photo copy of order dated 21.10.2025 passed by Hon'ble High Court of Sindh, Circuit Court, Hyderabad, in Cr. Revision Appln No.S-88 of 2025. Today complainant is present, while rest of the witnesses are not in attendance. Learned advocate of the complainant is present. Learned ADPP for the State is also present. The Hon'ble High Court of Sindh, Circuit Court, Hyderabad, in its above order has treated the said Cr. Revision Application as the condonation application for non-appearance of the accused before this Court on 20.09.2025. The Hon'ble Court has further ordered that the bail bond of accused remained intact as it was not cancelled, hence, the accused shall not be re-arrested till the decision of this Court. I have heard learned D/c, learned advocate of the complainant, as well as learned ADPP for the State. The learned D/c has read the case diaries of the case right from the date on which the accused appeared before the Court after getting bail from Hon'ble High Court of Sindh on the statutory ground. The record reflects that the accused remained in attendance on each and every date, but the case could not proceed on one and other reason. It is apparent from the case dairy dated 20.09.2025 that the accused was absent when the matter was called at 09:30 a.m. On that date PWs Muharram Ali, Nawab Ali, HC Ghulam Qadir, PC Ghulam Rabani, PC Asadullah, Dr. Nasreen and Tapedar Muhammad Ibrahim attended the Court. On the previous date viz. 30.08.2025 the PWs Muharram Ali, Nawab Ali, Inspector Ghulam Shabir, HC Ghulam Qadir, PC Ghulam Rabani and Muhammad Ibrahim Tapedar were in attendance, but the case was adjourned at the request of accused subject to cost of Rs.500/- as fare expenses to be paid to each PW. Further the record reflects that on the relevant date of hearing viz. 20.09.2025 when the accused failed to attend and the learned D/c was also not in attendance, this Court passed the order recalling the bail of the accused. However, on the same date, the late diary reflects that junior partner of the D/c was present and moved condonation application. It seems that the non-appearance of the accused before this Court was only on 20.09.2025, which was neither willful nor deliberate one causing delay in the case proceedings. In the larger interest of justice the NBW is recalled as the purpose has served after surrender of the accused before this Court today. He is directed to furnish a fresh P.R. bond of Rs.5,00,000/- for his attendance before the Court on each and every date till the disposal of the case. Learned advocate of the complainant is directed to produce the witnesses on the next date without fail as the case is old one. By consent the case is fixed on 08.11.2025 for evidence of the PWs. Office is directed to issue summons to all the officials witnesses. Call for case property if any. The accused on bail and the complainant who is present today shall attend on the next date. It is clarified that in case of default of either complainant side or defence in proceedings with the matter the adverse/coercive order shall be passed in accordance with the law. Late Diary.
