Learned Mr. Athar Ameer Pahore, learned ADPP for the state is present and heard. Judgment passed at Ex-30, and announced in open court, that accused have formed an unlawful assembly and committed the murder of deceased Naeemullah. The evidence regarding the occurrence, it is flawless and believable and there is sufficient evidence to prove that accused have committed an offence. Hence, having regard to the facts and circumstances of the case, they are hereby convicted under section 265-H(ii) Cr.P.C, and sentenced as follows. The accused Muhammad Haseen, Muhammad Sadique, Raheem Bux, Muhammad Pannah and Najamuddin, all by caste Pahore are convicted for offence punishable u/s 148, r/w section 149 P.P.C and sentenced to undergo for R.I for three years and to pay fine of Rs.10,000/= each accused and in case of failure, thereto, they shall suffer further SI for one month more. All present accused are also convicted for an offence u/s 302 (b) and sentence them imprisonment for life. A fine of Rs.5,00,000/- (Five Lacs) is also imposed on each of them. In case of non-payment of fine, they shall suffer R.I for one year more. Amount of fine, if recovered shall be paid to the heirs of deceased Naeemullah as compensation u/s 544-A Cr.PC and if they failed to paid, the amount shall be recovered from their land revenue. So far as sections 337-H(ii) & 504 PPC are concerned, I am of the firmed view that no evidence has been established against the accused for such offences. The benefit of Section 382-B Cr.P.C is also extended to the all present accused. The period of detention suffered during the trial, if any, shall be deducted from the term of their sentence. Accused Muhammad Haseen and Muhammad Panah are present in custody, they are remanded to Central Prison, Sukkur through Superintendent District Jail, Shikarpur along with conviction slip to serve out the sentence awarded to them in accordance with law. Accused Najamuddin, Muhammad Sadique and Rahim are present on bail, and taken into custody and they too remanded to Central Prison, Sukkur through Superintendent District Jail, Shikarpur along with conviction slip to serve out the sentence awarded to them in accordance with law. The case against the absconding accused, named above be kept on dormant file till their arrest. Let the copy of this judgment be delivered to all the accused as well as ADPP for the State on free of cost. Compared copy of Judgment supplied to accused free of costs and such receipt obtained from them which is kept on record at Ex.31.
