Further arguments heard .Judgement passed and announced in open court. accused (1) Mst. Fozia W/o Chakar, (2) Mst. Mirzadi W/o Ahmed, (3) Mst. Safia W/o Sattar, (4) Saeed Ahmed @ Saeedo, (5) Sattar, (6) Khan Muhammad, and (7) Chakar, are convicted accordingly U/s: 265-H(ii) Cr.PC against offence punishable U/s: 353, 225 PPC, each. As regards to the quantum of the sentences, learned State counsel could not submit materialistic evidence to prove the accused as previous convict are hardened criminals; therefore, male accused Saeed Ahmed @ Saeedo S/o Khan Muhammad, Sattar S/o Ghazi, Khan Muhammad S/o Ghulam Nabi, and Chakar S/o Abdul Aziz, taking lenient view are sentenced to suffer Simple Imprisonment of three (03) months and fine of Rs.2000/- against offence punishable U/S 225, and three (03) months and fine of Rs.2000/- against offence punishable U/S 353 PPC, each. Both sentences are to run concurrently. Nonetheless, lenient view is also taken against lady accused Mst. Fozia W/o Chakar, Mst. Mirzadi W/o Ahmed, and Mst. Safia W/o Sattar are sentenced to suffer Simple Imprisonment till rising of the Court and fine of Rs.5000/- against offence punishable U/S 225 PPC and 353 PPC. In case of failure to pay fine, the male accused shall serve S.I for further three days and in case of default by lady accused, they shall undergo S.I for five days. They are directed to deposit the fine before Nazir of this Court under token of receipt. Let the copy of judgment be provided to accused with free of cost under acknowledgment. Benefit of Section 382-B Cr.P.C, if any, is also awarded to the accused. All accused are present on bail except accused Sattar whose bail bond has already been forfeited; their bail bonds stand cancelled and sureties discharged. However, fate of surety of accused Sattar shall be dealt accordingly and case of absconding co-accused Rahib S/o Meer Muhammad, and Deedar S/o Meer Muhammad, against whom committal proceedings are still in progress, being bifurcated from present case, shall meet its own fate. Whereas, the case of (1) Zaheer S/o Sattar, (2)Sadar @ Sadroo S/o Sikandar Ali, (3) Abdul Ghaffar S/o Shaman, (4) Rafique S/o Ahmed, (5) Tofeeq S/o Ahmed, (6) Waheed S/o Noor Hassan, (7) Murtaza @ Mangni S/o Shaman, (8) Mst. Hooran W/o Mehar, all by caste Bozdar, being proclaimed offenders, is kept on dormant file, till their appearance or arrest. The present male accused are taken in custody and remanded to District Prison and Correctional Facility, Sukkur along with warrant of commitment to serve the sentence awarded.
