Session case called. All 05 accused namely 01. Gian, 02. Arshad Ali @ Arshad, 03. Ghulam Nabi @ Ghulam, 04. Gulzar and 05. Akbar Ali are present on bail. Mr. Hemoon Kolhi learned ADPP for state is present. Mr. Anand Ghan learned advocate is present and he has filed his vakalatanama on behalf all accused. Complainant namely Dino & injured P.W namely Alam and Ghulam are present. Both parties moved a joint application U/S 345(2) Cr.P.C at Ex-02. Order passed on it. Notice to DPP. Copy of the same is supplied to ADPP. Both parties also moved an other joint application U/S 345(6) Cr.P.C along with affidavits of complainant namely Dino & injured P.W namely Alam and Ghulam at Ex-03. Order passed on it. Notice to DPP. Copy of the same is supplied to ADPP. ADPP has given no objections on both applications Ex-02 & Ex-03. Arguments heard from both side. Order passed on separate sheets at Ex-04 & Ex-05 and announced in open court whereby applications Ex-02 & 03 are allowed and all the above named 05 accused are acquitted U/S 345(6) Cr.P.C. They are present on bail, their bail bonds stand cancelled and surety is discharged. |
