Case called. Associate counsel from the Plaintiff side is present and marked his attendance in morning. Today this matter was fixed at 10: 30 a.m for hearing on application U/o XIV Rule 5 CPC and an application U/s 128 (2) (H) CPC from plaintiff side with note of caution as last and final chance else appropriate order will be passed but inspite of that none is in attendance at 10.30 am from plaintiff side. This matter was also fixed upon C.A against application U/s 151 CPC filed by defendant No.17. Order passed on separate sheet. Same is hereby dismissed being infructuous. Defendant side have already argued upon the said application but plaintiff side are reluctant to pursue the said matter despite of extending note of caution, hence, the contentions made in the said applications are hereby treated arguments from plaintiff side and matter put-off to 26.01.2026 for order upon the application U/o XIV Rule 5 CPC and an application U/s 128 (2) (H) CPC. 2. So far application U/s 151 CPC moved on behalf of defendant No.17 is concerned, possession of Flat No.17 was sought to be handed over to him. Admittedly, old H.C Suit No.1594 of 2013 (New Suit No.4616 of 2025) filed by Sultan Ali Akbar Allana through attorney (i.e. defendant No.17 in the above suit) for possession and mesne profits in respect of same Flat No.17 which suit is already been disposed of vide order dated.19.11.2025 and possession thereof has been handed over to the defendant No.17, therefore, application U/s 151 CPC pending in this suit merits no consideration which is hereby dismissed being infructuous. 3. So far rest of pending applications is concerned, defendant side have already argued upon the said application but plaintiff side are reluctant to pursue the said matter despite of extending note of caution, hence, the contentions made in the said applications are hereby treated arguments from plaintiff side and matter is adjourned for order upon the said two pending applications. Put off to 26.01.2026. |
