Criminal Misc: application called. Applicant and his counsel are present. Learned ADPP for the state is present. SHO produce detenue two kids. report of DSP, complaints cell Shikarpur received. order passed and announced in open Court. In the instant case, applicant appeared before this court, whose children were produced by sister of their father. Applicant submitted that she was driven out by her husband by snatching both detenues. This Court observed that the age of her first elder daughter is not more than 4 years and second daughter is of about 6 months. The condition of both the children were self-speaking that they are not being properly maintained physically as well as emotionally. The welfare of siblings is to stay together along with mother. The younger children are more dependent on their mother to have remained with them. Primary care-givers to the children for their physical and psychological needs; therefore, in such circumstances the children ought to put stay together for the custody of mother for the time being and both detenues handed over to applicant.
