Matter called. Today matter is fixed for report of Nazir / further proceeding as well as submitted surety. Learned counsel for the plaintiff is present. Defendant is present. Order passed on separate sheet as The defendant was required to submit surety within time though time was extended but he failed to submit surety in compliance of order dated: 22.10.2025. The objects of order XXXVII CPC is to secure ends of justice. The spirit behind the provision of O.XXXVII, CPC is to provide efficacious remedy and to avoid prolongation of the suit. Object of the provision is to provide mechanism for speedy and summary remedy for recovery of money in respect of suit which are filed on the basis of promissory notes, bills of exchange, cheques and hundies. In the present case, upon filing suit for recovery of amount mentioned therein defendant had failed to submit surety in compliance of order dated: 22.10.2025. In the light of above discussion and circumstance the application under Order on application XXXVII Rule 3 CPC is hereby recalled and the plaintiff is directed to file his affidavit in evidence on next date of hearing positively. Now matter is fixed on 07.01.2025 for filing affidavit in evidence. |
