The suit of the plaintiff is decreed under section 10 (4) of the West Pakistan Family Court Act 1964. Accordingly, the marriage of the plaintiff with the defendant stands dissolved by way of Khulla in lieu of dower amount. The section 10 (4) of the West Pakistan Family Court Act 1964 requires that the Haq-e-Mehr if received by wife at the time of marriage shall be restored to the husband. Let the preliminary decree of khulla be prepared and the copy of the same be sent to the concerned union counsel for confirmation, as per law, however with regard maintenance and recovery of golden ornaments, issues will be framed and parties will led their evidence. The certified copy of decree be sent to the chairman concerned Union Council in compliance of section 21 sub-section (2) of the West Pakistan Family Court Act 1964 and upon receipt of such copy the Chairman shall proceed as if he had received an intimation of Talaq required to be given under Muslim Family Laws Ordinance, 1961.
