Matter Called. Learned advocate for the plaintiffs is present, notice received and endorsed on the face of the application under Order XXXIX rule 1 & 2 read with section 151 CPC that he wants to not press the application under the reason that this Court has already appointed Nazir as Receiver of the suit property vide Order dated: 22.09.2025.Order passed on separate order sheet.I have heard learned advocate for plaintiffs and perused available record. Consequent upon grant of applications I do hereby appoint Nazir of District & Sessions Court Karachi (South) as Receiver to take effectively charge over the suit properties i.e. Shop Nos. G/1 & G/2, measuring 179.32 square yards, existed as two premises on a portion of plot of land bearing Survey No. 53, Sheet No. NP-10, Old Survey No. 26/57, Situated at Daryalal Street, Napier Quarters, Jodia Bazar, Karachi. Before taking the charge, possession in his exclusive control under the lock & key the defendant Nos. 1 & 2 are given sixty (60) days notice period to move, to shift and change their respective business from the suit properties in the larger interest of justice failing whereof the Receiver shall be entitled to take over the suit properties under the lock & key in its exclusive control along with such compliance report to this Court till further orders. The Receiver shall be entitled to receive his fees in advance in the sum of Rs. 20,000/-. Put off to 03-11-2025 for hearing to pending application(if any). |

Order passed on separate order sheet, Be that as it may, it appears just and convenient to consider the relief so sought in the in hands applications I, therefore, in the light of sufficient un-rebutted evidence to hereby grant the both applications.
