The prosecution proved truth of charge against present accused to the hilt, thus I am convinced to convict him in terms of section 265-H (ii) Cr.P.C for offence punishable U/.S 320, 427 & 279 PPC so he stands sentenced (i)For offence punishable u/s 320 PPC to pay Diyat amount of Rs:9,828,670/ (Rupees Nine million eight hundred twenty eight thousand six hundred and seventy only as per notification dated:18-8-2025 by Finance Division Government of Pakistan), as well as to undergo R.I for ten years as Ta???zir. In case of nonpayment of Diyat amount in lump-sum for payment to legal heirs of deceased HC-1563 Abdul Wahid son of Muhammad Ibrahim Shaikh, he will remain inside prison till such payment of Diyat amount, (ii)For offence punishable u/s 279 PPC, to undergo R.I for (02) two years and fine of Rs.3000/-. In case of nonpayment convict at fault will undergo S.I for (06) six months more, (iii)For offence punishable u/s 427 PPC to undergo R.I for (02) two years and to pay fine of Rs.2,00,000/. In case of nonpayment convict at fault will undergo S.I for (06) six months more.The sentence of imprisonment so awarded will run concurrently and benefit of section 382-B Cr.P.C extended to the convict. Per file, convict was arrested on 17.11.2024 and he was released on bail on 11.01.2025 as per case diaries.Present accused (now convict) is present on bail so due to his conviction and sentence today he has been ordered to be taken into custody and remanded to Central Prison-I Sukkur through Incharge District Prison Ghotki along with conviction warrant, slip as well as CTC of this Judgment free of costs in order to serve out sentence and to file appeal against this Judgment subject to law and prison rules. Bail bond so furnished by him is cancelled and surety stands discharged. ?? |
