?? Bail before arrest called. In morning applicant/ accused and his counsel called present and requested to kept the matter till 10:00 AM to furnishing surety. Later-on applicant/ accused & his counsel called absent. Learned ADPP for the state is present. Perusal of record shows that accused was granted ad interim bail before arrest vide order dated 16.03.2026 subject to furnishing surety in sum of Rs.50,000/- (Rupees Fifty Thousand Only), however, applicant/accused has failed to furnish surety, it is now 02:40 PM. The relief of bail before arrest is an extraordinary relief which cannot be granted/extended in absence of accused. The accused was required to be present on time, but he remained absent. Therefore, interim bail granted to accused/ applicant vide order dated 16.03.2026 stands recalled and, bail application stands dismissed for non-prosecution and for want of surety. |
