Record shows that issues were framed on 14-07-2025, and matter is being adjourned without any progress on filing of adjournments applications by advocate for plaintiffs. On filing of such adjournment application, this court had already passed detail order dated 13-08-2025, highlighting the principle of last and final chance as held by Hon???ble supreme court of Pakistan in the case of Moon Enterprises CNG station Rawalpindi versus Northern gas pipeline Limited through General Manager Rawalpindi and others (2020 SCMR 300). However, on the last date of hearing viz. 24-09-2025 advocate for plaintiff again send adjournment application that he was busy before Hon: High Court of Sindh Circuit Court, Mirpurkhas, thus, seeing the circumstances, application was allowed and implications of order date 13-08-2025 was not invoked. However, today, advocate for the plaintiff is present, but neither plaintiff nor any of the witness is in attendance, which shows that plaintiff is not serious in proceeding with the suit in-spite of clear directions. It is settled principle of law that Law favors the vigilant not the indolent. Order passed and announced in open Court. In view of attending circumstances the suit of plaintiff is dismissed in non-prosecution as envisaged under Order IX R 8 CPC. |
