The whys and wherefores lead this court to order that, it is upon the mental health specialist who could only diagnose that the plaintiff is ???Schizophrenia??? patient or not and the defendant is not himself mental health specialist. The plaintiff is entitled to return of dowry articles i.e room set furniture, Fridge Dawlance 16 Cubic company, Air conditioner Changchun Ruba, Television Samsung 21, one dinner set,?? one set of Hot pot, Iron National Company, Juicer Set, oven Samsung company, Gas stove, one water set, one Toaster machine, Grinder, stew pot set special silver, one spoon set, one thermos Japan, and all other articles mentioned by the defendant in the list attached by him with his written statement and produced during his evidence at Exh. 13/B. OR to pay price/value in lum-sum to the tune of 40 % of their value., and or amount shall be recovered as arrears of land revenue, with a mark of caution that the rest of articles are of daily use, which owing to passage of considerable period of time has been either used and or worn and torn away by the parties during the span of subsistence of marital tie or might be damaged, hence those are denied including golden ornaments. Plaintiff No 1 is entitled to maintenance at rate of Rs.11,500/- (Eleven Thousands Five Hundred only) per month from November 2023, till Judicial separation, while defendant is directed to pay maintenance of his Baby Riya at the rate of rupees 8000/- (Eight Thousand only) per month from April 2019 and future at the same rate with 10 % annual increment up till his legal entitlement under the law of land, by the 05th of each calendar month. Suit of the plaintiff is partly decreed. No order to Costs. Office, to prepare the decree accordingly.
