The case called. Accused/UTP Zohaib Soomro has been produced in custody from Central Prison, Hyderabad. The co-accused, namely Mumtaz Soomro, Azizullah Soomro, and Muhammad Soomro, had already been acquitted under Section 265-K Cr. PC by this Court vide order dated 24.04.2019. Today, the matter is fixed for the cross-examination of the complainant, Ahmed Khan, and prosecution witness Abdul Sattar. Their examination-in-chief had been recorded on 04.10.2025, and thereafter several opportunities were afforded to the defence to conduct their cross-examination. Initially, the accused was represented by Mr. Muhammad Akram Sahito, Advocate, whose conduct repeatedly resulted in unnecessary delays, as he consistently avoided proceeding with the case on almost every date of hearing. Consequently, in exercise of the powers conferred upon this Court under Chapter VII, Clause 6 of the Federal Capital and Sindh Courts Criminal Circulars, Ms. Ghulam Kalsoom Gopang, Advocate, was appointed at Government expense to represent the pauper accused vide order dated 25.05.2026. When the case was taken up today, Ms. Irum, junior associate of Ms. Ghulam Kalsoom Gopang, appeared before the Court. Upon being asked why Ms. Gopang herself had not appeared, she stated that Ms. Gopang had not collected the case file from the accused and was, therefore, unprepared to proceed with the matter. This explanation reflects a lack of diligence and responsibility expected from counsel appointed at public expense, particularly a senior advocate. Despite having been afforded sufficient opportunities to prepare and proceed with the defence, Ms. Gopang sought an adjournment on the same ground, which demonstrates an irresponsible approach towards her professional obligations. In these circumstances, this Court is of the view that Ms. Ghulam Kalsoom Gopang cannot be permitted to continue representing the pauper accused. Accordingly, her appointment as counsel for the accused is hereby withdrawn. In her place, Mr. Muhammad Shahid Arain, Advocate, who is present in Court, has expressed his willingness to represent the accused. Upon inquiry, he stated that he has approximately fifteen years' standing at the Bar and possesses experience in conducting criminal cases before the District Judiciary as well as the Honourable High Court of Sindh. He has submitted his Vakalatnama, which is taken on record. Henceforth, with effect from the next date of hearing, Mr. Muhammad Shahid Arain, Advocate, shall be treated as learned counsel for the pauper accused, Zohaib Soomro.
