The learned counsel for the defendant No. 02 has submitted an application under Section 148 CPC, seeking an extension of time for filing of written statement at Ex. 34. The service upon the defendant No. 02 was held good vide order dated: 22-01-2026 (Ex 10) however despite attending couple of dates of hearing and having full knowledge of the proceedings, Defendant No. 02 has failed to file a written statement. As an indulgence, the instant application is hereby allowed as a last and final chance with directions to the defendant No. 02 to file written statement on the next date of hearing without fail in default he shall be deemed to have been debarred from filing of WS. Perusal of the case diaries further reveals that service upon the remaining defendants, Nos. 01, 03, 04, 05(i to viii), 06(i to vi), 07(i to iii), 10, and 11, was also held good vide the same order dated 22-01-2026 (Exh. 10). However, except defendants Nos. 05 to 07 and 11, none of the said defendants has filed a written statement to date. The defendants Nos. 01, 03, and 04, are hereby directed to file their written statements on the next date of hearing without fail, failing which they shall be deemed to have been debarred from filing of the written statement.
