F.C suit called. Order passed on order-sheet. Matter called. Plaintiff called absent. Learned counsel for the plaintiffs called absent though matter called repeatedly since morning and kept aside thrice at different times, it is 11:40 A.M but none appeared from the side of plaintiff No.02. Record reveals that cross-examination of the witness Muhammad Haneef and Shaikh Abdul Rehman was reserved on dated:05-01-2026 due to absence of learned counsel for plaintiff No.02. No intimation or application was moved on that date, however, their cross-examination was reserved. Today, the same position has been adopted has neither the plaintiff No.02 (L.Rs) nor their counsel appeared. No application or adjournment moved from their side. As such, cross-examination declared nil on part of plaintiff No.02. Cross-examination of aforesaid witnesses conducted by learned counsel for defendant No.01. Bailable warrants returned served upon aforesaid witnesses who appeared and their cross-examination was recorded except witness namely Ghulam Shakir who appeared belatedly after matter was adjourned already. Matter adjourned to 01-07-2026 for plaintiff witness evidence. Plaintiff witness namely Ghulam Shakir is directed to appear and get recorded his evidence. Plaintiff side is directed to produce his remaining witnesses till next date, failing which any appropriate order shall be passed.

Summons issued upon witnesses of plaintiff returned served upon plaintiffs witnesses No.01 to 06 as per bailiff report. It is fixed for cross-examination of plaintiff witnesses. The witnesses namely Abdul Ghani, Liaquat Ali Khan and Yasir Nazeer Shaikh appeared. Learned counsel for the defendant No.01 appeared. None appeared from rest of defendant side. Learned counsel for the plaintiff only marked his attendance and went away without waiting for call of the case. No intimation or adjournment been moved by plaintiff side either to keep aside the matter during course of the day or to adjourn it. Matter called repeatedly but learned counsel for the plaintiff did not bother to appear and proceed with the matter. Thereafter, evidence of aforesaid witnesses recorded. It appears that the witnesses Muhammad Haneef S/o Muhammad Ismail, Shaikh Abdul Rehman S/o Shaikh Muhammad Shafi, Ghulam Shakir S/o Muhammad Aziz failed to appear despite of receiving the copy of summon as per bailiff report. As such office is directed to issue bailable warrants against the said witnesses Muhammad Haneef S/o Muhammad Ismail, Shaikh Abdul Rehman S/o Shaikh Muhammad Shafi, Ghulam Shakir S/o Muhammad Aziz through S.H.O of concerned P.S. Per record, the witness Asif S/o Muhammad Iqbal Memon is resident of Karachi. Hence office is directed to issue summons upon plaintiff witness Asif S/o Muhammad Iqbal through registered post A.D and through T.C.S/ Leopards on costs of the plaintiff. The plaintiff side is directed to get issue the process upon witnesses by depositing such required cost by next date, failing which any appropriate order shall be passed.
